Zhrnutie:
Sťažovateľ požiadal o prevod domény <obrodenamatica.sk> z jej držiteľa na seba z dôvodu tvrdeného zásahu do svojich práv vyplývajúcich mu z názvu verejnoprávnej inštitúcie, ochrannej známky s účinkami v Slovenskej republike a doménového mena. V čase podania návrhu a vydania rozhodnutia bola doména <obrodenamatica.sk> verejne používaná. Expert konštatoval podobnosť domény s chránenými označeniami, dobré meno chráneného označenia a dobrú povesť sťažovateľa, ako aj existenciu pravdepodobnosti zámeny medzi doménou a chráneným označením. Držiteľ používa doménu na účely kritiky sťažovateľa ako verejnoprávnej ustanovizne. Nepreukázal však, že by bol jeho záujem na kritike tejto inštitúcie legitímny. Sťažovateľ naopak dostatočne preukázal nedostatok dobrej viery pri používaní domény Držiteľom, kedy bola webová stránka na doméne realizovaná ako kritická stránka slúžiaca ako nástroj konkurenčného boja proti sťažovateľovi a jeho predstaviteľom. Konštatujúc splnenie všetkých nutných podmienok stanovených v Pravidlách ADR Expert návrhu v celom rozsahu vyhovuje a prevádza doménu <obrodenamatica.sk> na sťažovateľa.
Summary:
The Complainant requested that a domain name <obrodenamatica.sk> be transferred from its Holder to itself on the basis of an alleged interference with its rights to the name of the public entity, trademark with the effect in the Slovak Republic and the domain name. At the time of submission proposal and at the time of decision about the complaint by the Expert, the <obrodenamatica.sk> domain was publicly used. The Expert stated the similarity of the domain with protected designations, the reputation of the protected designations, the reputation of the Complainant and the resultant likelihood of confusion between them. The Holder uses the domain for the purposes of criticizing the Complainant as a public institution. However, he has not shown that his interest in criticizing that institution is legitimate. On the contrary, the Complainant had sufficiently demonstrated a lack of good faith in the use of the domain by the Holder, when the website on the domain was implemented as a critical site serving as a tool in the competitive fight against the Complainant and its representatives. The Expert thus concluded that all necessary conditions required by the Rules of ADR were met and therefore ordered the transfer of the domain <obrodenamatica.sk> to the Complainant.
