Zhrnutie:
Sťažovateľ požiadal o prevod domény „cws.sk“ z jej Držiteľa na seba z dôvodu tvrdeného zásahu do práv k ochranným známkam „CWS“. Sťažovateľ podal svoj Návrh so súhlasom majiteľa Chráneného označenia. Držiteľ si predmetnú doménu registroval v čase, keď bol konateľom Sťažovateľa, pričom po tom, čo bol Držiteľ odvolaný z funkcie konateľa Sťažovateľa, poskytol predmetnú doménu k užívaniu konkurentovi Sťažovateľa. Expert konštatoval zhodnosť ochrannej známky „CWS“ s doménou „cws.sk“. Expert zároveň konštatoval, že Sťažovateľ nepreukázal existenciu dobrého mena Chránené označenia, v dôsledku čoho bolo nevyhnutné posudzovať podmienku existencie pravdepodobnosti zámeny. Expert dospel k záveru, že je daná pravdepodobnosť zámeny medzi Doménou Držiteľa a Chráneným označením. Sťažovateľ zároveň preukázal nedostatok dobrej viery pri registrovaní a používaní Domény zo strany Držiteľa. Konštatujúc splnenie všetkých nutných podmienok stanovených v Pravidlách ADR Expert vyhovel návrhu a nariadil prevod Domény na Sťažovateľa.
Summary:
The Complainant requested that a domain name „cws.sk“ is transferred from its current Domain name holder to itself on the basis of an alleged infringement of the trade marks “CWS”. The Complainant filed its Complain with the approval provided by the the owner of Protected Sign . The Domain name holder had registered the domain in his own name at the time he was an executive director of the Complainant; while after being revoked from the office of the executive director, the Domain name holder provided the given domain name to a competitor of the Complainant. The Expert concluded that the trade marks “CWS” are identical with the domain name „cws.sk“ At the same time the Expert concluded that the Complainant did not prove that the trade marks “CWS” are well-known, as a result of which the Expert had to assess whether the likelihood of confusion exists in this case. The Expert concluded that the likelihood of confusion exists in this case. Moreover, the Complainant proved the Domain name holder’s lack of good faith with respect to registration and using of the domain name. The ADR Expert thus concluded that all necessary conditions required by the Rules of ADR were met and therefore ordered the transfer of the domain to the Complainant.
