Zhrnutie:
Sťažovateľ požiadal o prevod domény „topregal.sk“ z jej Držiteľa na seba z dôvodu tvrdeného zásahu do svojich práv k Chránenému označeniu, na ktoré je registrovaná obrazová ochranná známka „TOPREGAL“. Držiteľ si doménu registroval po zaregistrovaní Chráneného označenia bez toho, aby ho na to Sťažovateľ oprávnil. Expert skonštatoval preukázanie existencie Chráneného označenia z dôvodu existencie ochrannej známky k označeniu „TOPREGAL“. Expert ďalej konštatoval zhodnosť označenia „TOPREGAL“, ktoré obsahuje aj ochranná známka s doménou „topregal.sk“. Sťažovateľ preukázal nedostatok dobrej viery Držiteľa najmä tým, že Doména buď nebola vôbec využívaná alebo bola využívaná Držiteľom na presmerovanie na doménu Držiteľa, ktorú využíval na ponúkanie rovnakého tovaru ako Sťažovateľ. Na koniec sám Držiteľ prejavil vôľu dobrovoľne previesť Doménu na Sťažovateľa. Vzhľadom na splnenie všetkých podmienok stanovených v Pravidlách ADR Expert vyhovel Návrhu a nariadil prevod domény na Sťažovateľa.
Summary:
The Complainant sought the transfer of the Domain „topregal.sk“ from its Holder due to the alleged interference with his rights to the Protected Sign, for which the trademark „TOPREGAL“ is registered in the name of the Complainant. The Holder registered the Domain without the Complainant´s consent. The Expert found that the Protected Sign had been established because of the existence of the trademark „TOPREGAL“. The Expert further stated that the trademark „TOPREGAL“ is identical with the Domain „topregal.sk“. The Complainant demonstrated the Holder’s lack of good faith, in particular by the fact that the Domain was not used at all or was used by the Holder to redirect internet traffic onto a different domain of the Holder, which was used by him to offer the same goods as Complainant. Furthermore, the Holder himself expressed a willingness to voluntarily transfer the Domain to the Complainant. With regard to the fulfillment of all conditions set out in the ADR Rules, the Expert granted the proposal and ordered the transfer of Domain to the Complainant.
