Zhrnutie:
Sťažovateľ požiadal o prevod domény <madel.sk> z jej Držiteľa na spoločnosť Madel S.p.A. z dôvodu tvrdeného zásahu do práv Sťažovateľa k ochranným známkam obsahujúcim slovný prvok „Madel“ a do práv k obchodnému menu Sťažovateľa. Sťažovateľ v konaní preukázal existenciu chráneného označenia a preukázal aj to, že Doména <madel.sk> je zhodná s Chráneným označením. Zároveň bolo konštatované aj splnenie podmienky pravdepodobnosti zámeny, ako aj to, že Doména bola zaregistrovaná či získaná bez toho, aby mal súčasný Držiteľ k Doméne, respektíve Chránenému označeniu, právo alebo legitímny záujem. Sťažovateľ však neuniesol dôkazné bremeno vo vzťahu k preukázaniu toho, že Doména nebola zaregistrovaná, získaná a používaná v dobrej viere. Nedošlo tak k splneniu jednej zo základných podmienok, ktoré Pravidlá ADR požadujú pre dosiahnutie úspechu Sťažovateľa vo veci. The Complainant requested that the domain name <madel.sk> is transferred from its current Domain name holder to the company Madel S.p.A. on the basis of an alleged infringement of the Complainant’s trade mark rights containing the word element “Madel” and the infringement of the Complainant’s company name. The Complainant succeeded in proving both the existence of the protected sign and identity with the Domain <madel.sk>. At the same time, it was confirmed that the existence of a likelihood of confusion was established. Moreover, it was established that the Domain was registered or acquired without the Domain name holder having the right or legitimate interest. The Complainant, however, did not meet its burden of proof in relation to showing that the Domain was not registered, acquired, and used in good faith. Thus, one of the basic conditions required by the ADR Rules for the Complainant’s success in the matter has not been met. Noting that the necessary conditions set out in the ADR Expert Rules have not been met, the Complainant’s proposal to transfer the Domain has been rejected.
