Zhrnutie:
Sťažovateľ požiadal o prevod domény <c-and-a-online.sk> z jej Držiteľa na seba, a to z dôvodu tvrdeného zásahu do svojich práv z ochranných známok „C&A“ s účinkami aj v Slovenskej republike. Doména bola v čase podania návrhu nepoužívaná, avšak preukázané bolo jej používanie v minulosti. Expert konštatoval podobnosť Chráneného označenia s Doménou a tiež dobré meno Chráneného označenia v relevantnej časti verejnosti. Subjektívne právo ani legitímny záujem k Doméne neboli Držiteľom tvrdené ani preukázané. Sťažovateľ dostatočne preukázal nedostatok dobrej viery Držiteľa pri registrácii Domény (s poukazom na dobré meno Chráneného označenia) a minulom používaní Domény (s poukazom na prevádzkovanie parazitujúcej webstránky na Doméne). Konštatujúc splnenie všetkých nutných podmienok stanovených v Pravidlách ADR Expert návrhu v celom rozsahu vyhovel.
Summary:
The Complainant requested the transfer of the domain <c-and-a-online.sk> from its Holder to itself, namely on the ground of alleged infringement of his rights under the trademarks „C&A“ with effects also in the Slovak Republic. The domain name was not in use at the time of filing the complaint, but the proven past use of the domain name had been established. The Expert noted the similarity of the Protected Sign with the Domain Name and also the reputation of the Protected Sign among the relevant public. Neither a subjective right nor a legitimate interest in the Domain Name was claimed by the Holder nor proven. The Complainant has sufficiently demonstrated the lack of good faith on the part of the Holder in registering the Domain (also referring to the goodwill of the Protected Mark) and the past use of the Domain (also referring to the operation of a parasitic website on the Domain). The Expert thus concluded that all necessary conditions required by the ADR Rules were met and therefore ordered the transfer of the domain <c-and-a-online.sk> to the Complainant.
