Zhrnutie:
Sťažovateľ požiadal o prevod domény „venira.sk“ z jej Držiteľa na seba z dôvodu tvrdeného zásahu do svojich práv k Chránenému označeniu „VENIRA“. Držiteľ si doménu registroval bez toho, aby ju akýmkoľvek skutočným spôsobom využíval. Expert skonštatoval preukázanie existencie Chráneného označenia vzhľadom na existujúcu registrácie platnej ochrannej známky. Expert ďalej konštatoval zhodnosť nezapísaného označenia „VENIRA“ s doménou „venira.sk“, pričom bola konštatovaná pravdepodobnosť zámeny medzi Doménou Držiteľa a Chráneným označením. Expert zároveň konštatoval, že Sťažovateľ nepreukázal existenciu dobrého mena Chráneného označenia, v dôsledku čoho bolo nevyhnutné posudzovať podmienku pravdepodobnosti zámeny. Sťažovateľ preukázal nedostatok dobrej viery Držiteľa tým, že Doména nebola skutočne používaná po celú dobu jej držby Držiteľom, od 3.5.2018. Vzhľadom na splnenie všetkých podmienok stanovených v Pravidlách ADR Expert vyhovel návrhu a nariadil prevod domény na Sťažovateľa.
Summary:
The Complainant sought domain name transfer of the domain „venira.sk“ from the Holder onto him, the reasoning being alleged infringement of his rights to the Protected sign „VENIRA“. The Holder registered the Domain without any factual use whatsoever. The Expert concluded that the existence of Protected sign was vindicated considering the existence of a valid trademark. The Expert then concluded that the unregistered sign „VENIRA“ and the Domain „venira.sk“ are identical, also finding the likelyhood of conclusion between the two. The Expert also decided that the Complainant didnt prove the Protected sign is well-known, as a result of which The Expert had to assess whether the likelyhood of confusion exists in this case. The Complainant proved the absence of good faith of The Holder, arguing the Domain was not factually used for the whole time of possesion by the Holder, since 3.5.2018. Expert thus concluded that all necessary conditions required by the Rules of ADR were met and therefore ordered the transfer of the domain to the Complainant.
