Zhrnutie:
Sťažovateľ požiadal o prevod domény „rennie.sk“ z jej Držiteľa na seba z dôvodu tvrdeného zásahu do svojich práv k ochrannej známke „RENNIE“. Držiteľ si predmetnú doménu registroval bez toho, aby ju akýmkoľvek spôsobom skutočne používal. Expert konštatoval zhodnosť ochrannej známky „RENNIE“ s doménou „rennie.sk“, pričom bola konštatovaná pravdepodobnosť zámeny medzi Doménou Držiteľa a Chráneným označením. Sťažovateľ nepreukázal existenciu dobrého mena Chránené označenia, v dôsledku čoho bolo nevyhnutné posudzovať podmienku pravdepodobnosti zámeny. Sťažovateľ preukázal nedostatok dobrej viery pri používaní Domény Držiteľom tým, že bolo ustálené, že Doména bola zaregistrovaná alebo získaná s cieľom zabrániť Sťažovateľovi použiť Chránené označenie v rámci zodpovedajúcej Domény, a zároveň nebola Doména skutočne používaná po dobu najmenej 2 rokov od 1.9.2017. Konštatujúc splnenie všetkých nutných podmienok stanovených v Pravidlách ADR Expert vyhovel návrhu a nariadil prevod Domény na Sťažovateľa.

The Complainant requested that a domain name „rennie.sk“ is transferred from its current domain name holder to itself on the basis of an alleged infringement of rights to the Complainant’s trade mark „RENNIE“. The domain name holder registered the domain, but he has not used the domain in any way whatsoever. The Expert concluded that the Complainant’s trade marks „RENNIE“ are identical with the domain name „rennie.sk“ and that likelihood of confusion exists between them. The Complainant did not prove that its trade marks are well-known, as a result of which the Expert had to assess whether the likelihood of confusion exists in this case. The Complainant proved the domain name holder’s lack of good faith with respect to using the domain name in a way in which the domain name holder registered or acquired the domain with the purpose of preventing the Complainant from using its trade marks as the domain name, and at the same time, the domain in question was not genuinely used for more than 2 years after 1 September 2017. The ADR Expert thus concluded that all necessary conditions required by the Rules of ADR were met and therefore ordered the transfer of the domain to the Complainant.
