Zhrnutie:
Sťažovateľ požiadal o prevod domény backmarket.sk z jej Držiteľa na seba, a to z dôvodu tvrdeného zásahu do svojich práv z ochrannej známky „BACK MARKET“ s účinkami v Slovenskej republike. V čase podania návrhu a vydania rozhodnutia Experta nebola doména verejne používaná. Expert konštatoval zhodnosť Chráneného označenia s doménou
a existenciu pravdepodobnosti zámeny medzi nimi. Subjektívne právo ani legitímny záujem
k doméne neboli Držiteľom preukázané. Sťažovateľ dostatočne preukázal nedostatok dobrej viery pri získaní a používaní domény Držiteľom, konkrétne získanie Domény s cieľom zabrániť Sťažovateľovi použiť Chránené označenie v rámci zodpovedajúcej Domény, pričom Držiteľ sa zapojil do takéhoto nekalého jednania opakovane, pričom všetky okolnosti nasvedčujú tomu, že ide o tzv. domain grabbing. Doména nebola skutočne používaná po dobu najmenej 2 rokov odo dňa jej registrácie alebo od 1.9.2017 podľa toho, čo nastalo neskôr. Konštatujúc splnenie všetkých nutných podmienok stanovených v Pravidlách ADR Expert návrhu v celom rozsahu vyhovel.
Summary:
The Complainant requested that a domain name backmarket.sk be transferred from its current domain name holder to the Complainant on the basis of an infringement of its right to trademarks „BACK MARKET“, with effect for the Slovak Republic. At the time of submission and decision about the complaint by the Expert, the domain name backmarket.sk was not publically used. The Expert concluded that the trademark „BACK MARKET“ and the domain name backmarket.sk are identical and that a likelihood of confusion exists between the two. The domain holder did not prove any right or legitimate interest concerning the domain name. The Complainant did sufficiently prove the lack of good faith in acquiring the domain by the Holder, in concreto, acquiring the domain with the aim to prevent the Complainant from using the Protected Designation within the corresponding domain, while the Holder has been involved repeatedly in such misconduct, whereas all circumstances suggest that it is a case of so-called domain grabbing. The domain has not actually been used for at least two years from its registration or from 1st September 2017, as the case may be. The Expert thus concluded that all necessary conditions required by the Rules of ADR were met and therefore ordered the transfer of the domain backmarket.sk to the Complainant.
