Zhrnutie:
Sťažovateľ požiadal o prevod domén „abcom-store.sk“, „abcomcz.sk“, „abcomczech.sk“, „abcomstore.sk“, „ab-comcz.sk“, „ab-comczech.sk“, „ab-comstore.sk“ z jej držiteľa na seba, a to z dôvodu tvrdeného zásahu do svojich práv z nezapísaného označenia, obchodného mena a ochranných známok s účinkami v Slovenskej republike. Expert konštatoval zhodnosť aj podobnosť chránených označení s doménou a existenciu pravdepodobnosti zámeny medzi nimi. Subjektívne právo alebo legitímny záujem k doméne neboli držiteľom preukázané. Sťažovateľ dostatočne preukázal nedostatok dobrej viery pri získaní a používaní domény držiteľom tým, že k registrácií domén došlo bezprostredne po vydaní odborného rozhodnutia experta č. 46/2023, ktoré sa týkalo rovnakého chráneného označenia, ako aj tým, že držiteľ využíval doménu „abcomcz.sk“ na prevádzkovanie svojho internetového obchodu, ako aj podporne tým, že v rámci služieb vyhľadávača využíva službu kľúčového slova zhodného s chráneným označením (obchodným menom), v dôsledku čoho sa potom vo výsledkoch vyhľadávania zobrazuje na prvom mieste sponzorovaný odkaz na doménu s reklamným textom na internetový obchod držiteľa so zameraním aj na územie Slovenskej republiky, slovenského zákazníka. Konštatujúc splnenie všetkých nutných podmienok stanovených v Pravidlách ADR, expert návrhu v celom rozsahu vyhovel.
Summary:
The Complainant requested the transfer of the domains „abcom-store.sk“, „abcomcz.sk“, „abcomczech.sk“, „abcomstore.sk“, „ab-comcz.sk“, „ab-comczech.sk“, „ab-comstore.sk“ from its holder to itself on the ground of alleged interference with its rights under an unregistered sign, trade name and trademarks having effect in the Slovak Republic. The expert concluded that the protected signs were both identical and similar to the domain name and that there was a likelihood of confusion between them. No subjective right or legitimate interest in the domain was demonstrated by the holder. The Complainant has sufficiently demonstrated a lack of good faith in the acquisition and use of the domain by the holder in that the registration of the domains took place immediately after the issuance of Expert Decision No 46/2023, which concerned the same protected sign, as well as the holder’s use of the domain „abcomcz.sk“ for the operation of its online shop and, in support thereof, by using a keyword service identical to the protected sign (trade name) in the search engine services, which then resulted in a sponsored link to the domain name appearing in the first place in the search results, with advertising text for the holder’s online shop, also focusing on the territory of the Slovak Republic, the territory of the Slovak customer. Noting that all the conditions set out in the ADR Rules have been met, the expert granted the application.
